Bicycles & Pedestrians

According to Florida DMV statistics, 58 pedestrians were killed and 1,357 were injured in 1,546 crashes involving pedestrians. Over a ten-year period, 5,149 pedestrians lost their lives on Florida roadways and an additional 76,935 were injured. In fact, a pedestrian is killed every two hours in the US.

In Florida, 48% of pedestrians are killed while crossing the road but not at an intersection, just over 13% of pedestrians are killed while crossing the road at an intersection, and 6% are killed while walking on the road with traffic.

Counties such as Miami-Dade have the highest number of pedestrian fatalities in the state. Pedestrian accidents involving bodily injury can occur on streets, highways, avenues, boulevards, state highways, sidewalks or crosswalks.

They can be caused by cars, trucks, motorcycles, scooters, bicyclists, Uber or Lyft drivers, smart cars or even golf carts. A car driving only 10 miles per hour can severely disable a pedestrian.

The real tragedy of pedestrian accidents involving bodily injury is that the pedestrian has no protection and usually suffers the worst in any collision.

At the Law Offices of Jose R. Fernandez, P.A., we understand the emotional and physical challenges that develop after an automobile and motorcycle accident. When extensive injuries, property damage and even death result, you and your loved ones deserve to be compensated for your losses.

Unfortunately, there are regulations in place in the state of Florida that complicate insurance claims and make it difficult to recover compensation for your injuries and pain and suffering without the help of an experienced attorney.

In these cases, our team of auto and motorcycle accident attorneys will work tirelessly on your behalf, collecting, analyzing and presenting evidence to ensure you receive the fair and just settlement you deserve.

Common causes of pedestrian accidents include:
  • Inattention
  • Failure to comply with speed limits.
  • Failure to use turn signals
  • Aggressive driving
  • Texting and cell phone use
  • A driver impaired by alcohol or drugs.
  • Driver disobeying traffic signs or signals.

When negligent drivers fail to exercise an appropriate level of care on the road and their actions result in the injury or death of a cyclist, they should be held accountable.

Our bicycle accident lawyers in The Law Offices of Jose R. Fernandez, P.A. is proud to have helped countless bicyclists take on negligent drivers and their insurance companies to recover compensation for their injuries and property damage.

Our bicycle accident attorneys routinely pursue government agencies that have neglected to provide a reasonably safe environment for bicyclists to use.

Not only does this help our clients reorganize their lives after a traumatic bicycle accident, but the lawsuits put much-needed pressure on all levels of government to make our roads safer for drivers and pedestrians.
